Welcome to John Wallford. These Terms & Conditions ("Terms") are a binding agreement between you and Wallford Shoes LLC ("John Wallford", "we", "us", or "our"), a Florida multi-member limited liability company, regarding your use of this website and your purchases from us (the "Services").
PLEASE READ SECTION 15 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION AND INCLUDES A WAIVER OF CLASS ACTIONS AND JURY TRIALS, UNLESS YOU OPT OUT AS DESCRIBED THERE.
1. About us
John Wallford is a brand of Wallford Shoes LLC, headquartered at 7345 W Sand Lake Rd, Ste 309, Orlando, Florida 32819, United States. Our products are handcrafted in Brazil by our affiliated manufacturing company and imported into the United States by Wallford Shoes LLC.
2. Eligibility
You must be at least 18 years old to make a purchase. By using the Services, you confirm that the information you provide is accurate and that your use complies with applicable law.
3. Products
Our products are made by hand from natural materials such as leather and suede. Natural variations in grain, texture, and color are characteristics of genuine materials, not defects. Leather soles naturally darken and show wear with use. Colors may vary slightly depending on your screen.
4. Prices, duties, and taxes
Prices are listed in U.S. dollars (USD). All import duties are handled by us and are never charged to you at delivery. Applicable state sales tax is calculated at checkout. We may change prices at any time; changes do not affect orders already confirmed.
5. Orders and acceptance
Your order is an offer to purchase. We may decline or cancel any order, including orders with pricing or product errors, suspected fraud, or orders placed by resellers. If we cancel an order after payment, we will issue a full refund.
6. Payment
Payment is charged at checkout and processed securely by our payment providers. You authorize us to charge the total amount of your order, including shipping and applicable sales tax, to your selected payment method.
7. Shipping, returns, and refunds
Shipping, returns, exchanges, and refunds are governed by our Shipping & Returns policy, which forms part of these Terms. Title and risk of loss pass to you upon delivery of the order to your shipping address.
8. Promotions
Only one promotional code may be used per order, and promotional codes cannot be combined with sale items unless stated otherwise. Promotions may be modified or withdrawn at any time.
9. Communications
By providing your email or phone number, you agree to receive transactional messages about your orders. Marketing emails and text messages are sent only with your consent; you may opt out at any time using the unsubscribe link or by replying STOP. Message and data rates may apply.
10. Intellectual property
All content on this website, including text, images, product designs, logos, and the John Wallford and Wallford names and marks, belongs to Wallford Shoes LLC, its affiliates, or its licensors. You may not copy, reproduce, or use any content without our prior written consent.
11. Reviews and user content
If you submit reviews, photos, or other content, you grant us a worldwide, royalty-free license to use, reproduce, and display that content in connection with our brand. You confirm that your content is accurate, lawful, and does not infringe the rights of others.
12. Prohibited use
You agree not to use the Services for any unlawful purpose, to interfere with their security or operation, to impersonate others, or to submit false information.
13. Disclaimers
Except as expressly stated in our policies, the Services are provided "as is" and "as available," to the fullest extent permitted by law. Nothing in these Terms limits any rights you may have that cannot be waived under applicable consumer protection law.
14. Limitation of liability
To the fullest extent permitted by law, Wallford Shoes LLC, its members, managers, affiliates, and employees will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim will not exceed the greater of the amount you paid for the product giving rise to the claim or US$ 100.
15. Dispute resolution and arbitration
15.1 Informal resolution. Before filing any claim, you agree to contact us at john@johnwallford.com and attempt to resolve the dispute informally for at least 30 days.
15.2 Binding arbitration. Any dispute not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may instead bring an individual claim in small claims court.
15.3 Class action waiver. You and we may bring claims only in an individual capacity and not as a plaintiff or class member in any class or representative proceeding.
15.4 Opt-out. You may opt out of this arbitration agreement within 30 days of your first purchase by emailing us with your full name, order number, and a statement that you wish to opt out.
16. Governing law and venue
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law. For any matter not subject to arbitration, the state and federal courts located in Orange County, Florida, will have exclusive jurisdiction.
17. Privacy
Your use of the Services is also governed by our Privacy Policy.
18. Changes
We may update these Terms from time to time. Changes take effect when posted and apply to orders placed after that date.
19. Notice to California residents
Under California Civil Code Section 1789.3, California residents may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
